AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in charter schools, providing for
invoices for special education services.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 1725.1-A. Invoices for Special Education Services.--
(a) Notwithstanding any other provision of law:
(1) During the 2023-2024 school year and each school year
thereafter, each charter school, regional charter school and
cyber charter school that provides special education services
for a student and that seeks payments for the special education
services shall provide to the school district of residence of
the student an invoice, or periodic invoices, specifying the

special education services actually provided to the student and
the cost of providing the special education services to the
student, along with any documentation required by the school
district of residence.
(2) Payments for special education services under this
section shall be made to the charter school, regional charter
school and cyber charter school only after submittal of the
invoice, or periodic invoices, and review of the information
provided.
(3) The amount of the payments for special education
services under this section shall be in lieu of any rate or
calculation specified under this chapter or any other provision
of law.
(b) The department shall develop a form for the invoice
described in subsection (a). The form shall be posted on the
publicly accessible Internet website of the department.
Section 2. This act shall take effect immediately.
