AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in professional employees, providing
for educator data collection and reporting; and making an
editorial change.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Subarticle (a) heading of Article XI of the act
of March 10, 1949 (P.L.30, No.14), known as the Public School
Code of 1949, is amended to read:
(a) [Definitions] Preliminary Provisions.
Section 2. The act is amended by adding a section to read:
Section 1102. Educator Data Collection and Reporting.--(a)
The department shall require a school entity to submit annually,
by a date and in a manner prescribed by the department, the
following data:
(1) The number of vacant positions by school, certification
area and specific assignment.

(2) The number of teachers on emergency permits itemized by
school, certification area, specific assignment, type of permit
and demographic information.
(b) To the extent that money is appropriated or made
available to the department for the following purposes:
(1) The department shall consult with the Committee on
Education Talent Recruitment, as established in section 1503-K,
and educational researchers with expertise in educator workforce
data, in the development of public dashboards related to the
educator workforce, according to the following timeline:
(i) Within sixty (60) days of the effective date of this
section, the department shall provide the committee and
designated researchers with a comprehensive list of data
elements related to the educator workforce that are collected by
the department, designating for each element:
(A) Whether it is required by law or regulation, optional or
conditionally required.
(B) Whether and how the data is disaggregated.
(C) By what method the data is collected and reported,
including the person or entity responsible for reporting the
data.
(D) The deadline and frequency for reporting the data.
(E) The purpose and use of the data.
(ii) Within one hundred twenty (120) days of the effective
date of this section, the department shall, in consultation with
the committee and educational researchers, and after researching
and evaluation national and State dashboard examples, determine
appropriate evidence-based indicators to be included in the
dashboards.
(iii) Within six (6) months of the effective date of this

section, the department shall publish on an educator workforce
page or index of the department's publicly accessible Internet
website public dashboards related to the educator workforce that
allow members of the public to view, disaggregate and manipulate
educator workforce data already collected by the department.
(iv) The department shall continue to consult with the
committee and educational researchers no less frequently than
every six (6) months to identify areas for improvement relating
to the public dashboards and any additional evidence-based
indicator that could be added using educator workforce data
already collected by the department.
(v) The department shall update the educator workforce page
or index based on updated data no less frequently than once per
year. Data published on the dashboards shall be published within
no more than one (1) year of being collected.
(2) The dashboards may display data, including, but not
limited to, the following:
(i) Educator supply data, including educator preparation
provider enrollment and completion data and education
professional certificates issued by the department,
disaggregated by categories, such as program, certification area
and demographic information.
(ii) Educator demand data, including current educator
workforce numbers, vacant positions and rates, new hires and
emergency permits or out-of-field educators, disaggregated by
categories, such as school entity, school, specific assignment,
certification area, type of emergency permit and demographic
information.
(iii) Educator preparation program outcomes data, including
data on percentage of program enrollees who:

(A) Complete the program.
(B) Pass the certification test on the first time and
overall.
(C) Receive certification.
(D) Are employed by a school entity in years one through
five.
(E) Are retained by a school entity in years one through
five.
(iv) Educator retention at one-year, three-year and five-
year rates, disaggregated by categories, such as school entity,
school, specific assignment, certification area, type of
emergency permit and demographic information.
(3) The department may contract with an outside organization
with expertise in data analytics and visualization to develop
and administer the dashboards.
(4) The department may provide, from money appropriated to
the department, financial assistance to a school entity in order
to promote compliance with the duty under subsection (a).
(c) Within six (6) months of the effective date of this
section and annually thereafter, the department, in consultation
with the Department of Labor and Industry, shall issue a report
on the educator workforce of this Commonwealth. The report shall
include, but not be limited to, information on:
(1) Trends in educator supply and educator preparation
provider effectiveness, including recommendations for attracting
more high-quality and diverse teacher candidates and improving
the quality of educator preparation in this Commonwealth.
(2) The educator positions, by certification area, in high
demand in this Commonwealth and the location of existing
vacancies by school entity.

(3) Projections of shortage areas and subjects in the
upcoming three (3) to five (5) years and recommendations for
addressing these shortages.
(4) Overall and disaggregated trends in educator retention,
including recommendations for improving retention.
(d) The department shall submit annually the report required
by subsection (c) to the Governor and the General Assembly no
later than December 15 of each year and shall post the data and
the report on the department's publicly accessible Internet
website.
(e) As used in this section:
"Department" means the Department of Education of the
Commonwealth.
"School entity" means a school district, cyber charter
school, charter school, regional charter school, area career and
technical school or intermediate unit.
Section 3. This act shall take effect immediately.
