AN ACT
Amending Title 42 (Judiciary and Judicial Procedure) of the
Pennsylvania Consolidated Statutes, in judicial boards and
commissions, providing for structured fines.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 42 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 2154.8. Structured fines.
(a) Adoption.--The commission shall adopt guidelines for the
use of structured fines, in consultation with the planning
committee established under subsection (b), using guidelines
found in Monograph NCJ 156242, regarding the use of structured
fines as an intermediate sanction, of the United States
Department of Justice, Office of Justice Programs, Bureau of
Justice Assistance.
(b) Planning committee.--To aid in the creation of
structured fine guidelines, the commission shall establish a
planning committee, which shall be comprised of at least the

following individuals:
(1) A chief or presiding judge of a court of common
pleas.
(2) A prosecutor.
(3) A public defender.
(4) A representative of the private defense bar.
(5) A court administrator.
(6) An agency director for pretrial services.
(7) A chief probation officer or director of a community
corrections agency within this Commonwealth.
(8) A sheriff or jail administrator.
(9) At least three individuals who are active members of
a criminal justice advocacy group within this Commonwealth.
(10) Any other individual that the commission finds
necessary for creating the guidelines.
(c) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"Structured fine." A monetary sanction adjusted according to
the seriousness of the offense and the financial status of the
offender. The term is also referred to as a day fine.
Section 2. This act shall take effect in 60 days.
