AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in pupils and attendance, providing
for use of geolocation system for attendance in cyber school
program.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 1327.4. Use of Geolocation System for Attendance in
Cyber School Program.--(a) A cyber school shall use a
geolocation system to confirm attendance of its students.
(b) A cyber school shall establish a procedure for a parent
or legal guardian of a student to request and obtain a temporary
exception for the student from the geolocation system for a
reasonable period of time, so long as the parent or legal
guardian maintains residency within the school district.
(c) As used in this section, the following words and phrases

shall have the meanings given to them in this subsection unless
the context clearly indicates otherwise:
"Cyber school" includes:
(1) a cyber charter school defined under section 1703-A; and
(2) an online school or program provided by a school
district.
"Geolocation system" means a mechanism to:
(1) detect and confirm the physical location of a student
with the student's school district of residence when the student
accesses a cyber school's online learning management system;
(2) dynamically monitor the student's location; and
(3) block an attempt to access the online learning
management system throughout the online learning session when
the student is outside the student's school district of
residence.
Section 2. This act shall take effect in 60 days.
