AN ACT
Amending the act of February 14, 2008 (P.L.6, No.3), entitled
"An act relating to the public school system, including
certain provisions applicable as well to private and
parochial schools; amending, revising, consolidating and
changing the laws relating thereto," providing for State
System of Higher Education; and, in State-related
institutions, further providing for contents of report.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of February 14, 2008 (P.L.6, No.3), known
as the Right-to-Know Law, is amended by adding a chapter to
read:
CHAPTER 14
STATE SYSTEM OF HIGHER EDUCATION
Section 1401. Definitions.
The following words and phrases when used in this chapter
shall have the meanings given to them in this section unless the
context clearly indicates otherwise:
"State System institution." An institution listed under
section 2002-A of the act of March 10, 1949 (P.L.30, No.14),

known as the Public School Code of 1949.
Section 1402. Reporting.
No later than May 30 of each year, a State System institution
shall file with the Governor's Office, the General Assembly, the
Auditor General and the State Library the information specified
in section 1403.
Section 1403. Contents of report.
The report required under section 1402 shall include the
following:
(1) All information required by Form 990 or an
equivalent form of the United States Department of the
Treasury, Internal Revenue Service, entitled the Return of
Organization Exempt From Income Tax, except individual donor
information, regardless of whether the State System
institution is required to file the form by the Federal
Government.
(2) The salaries of all employees of the State System
institution with an income at least 50% higher than the
median household income in this Commonwealth.
(3) The highest 50 salaries paid to employees of the
State System institution that are not included under
paragraph (2).
(4) Use of money appropriated by the General Assembly.
(5) The receipt of money from the Redevelopment
Assistance Capital Program and all other State money not
appropriated by the General Assembly.
(6) Proof of compliance with 44 Pa.C.S. Ch. 73 (relating
to law enforcement background investigations and employment
information).
(7) How many days labor unions within the State System

institution have been on strike and how many days the State
System institution has been in negotiations with labor
unions.
(8) Broad demography and pay equity data of the State
System institution, including undergraduate students,
graduate students, adjunct professors, non-tenure-track
professors, tenure-track professors, tenured professors and
administrators based on length of service, department and
level of management.
(9) Pension investments.
(10) The existence of environmental, social and
corporate governance (ESG) policies.
(11) Vendors with one-year or multiyear contracts in
excess of $25,000 and disaggregated demography of the
vendors.
(12) Education affordability data, including:
(i) The percentage of students that graduated from
local and adjacent school districts or community
colleges.
(ii) The percentage of the student body that are
Pennsylvania residents.
(iii) Graduation rates disaggregated by whether the
student graduated from a local and adjacent school
district or community college and status as a
Pennsylvania resident.
(iv) The percentage of applicants admitted who are
Pennsylvania residents.
(v) The percentage of each entering class that are
Pennsylvania residents.
(vi) The median net price of higher education for

Pennsylvania residents at the State System institution.
(vii) The percentage of Pennsylvania residents that
graduate within four to six years.
(13) The number and amounts of scholarships offered to
applicants according to national origin, state and zip code.
Section 1404. Copies and posting.
A State System institution shall maintain, for at least seven
years, a copy of the report in the State System institution's
library and shall provide free access to the report on the State
System institution's publicly accessible Internet website.
Section 2. Section 1503 of the act is amended to read:
Section 1503. Contents of report.
The report required under section 1502 shall include the
following:
(1) [Except as provided in paragraph (4), all] The
information required by Form 990 or an equivalent form of the
United States Department of the Treasury, Internal Revenue
Service, entitled the Return of Organization Exempt From
Income Tax, except individual donor information, regardless
of whether the State-related institution is required to file
the form by the Federal Government.
(2) The salaries of all [officers and directors]
employees of the State-related institution[.] with an income
at least 50% higher than the median household income in this
Commonwealth.
(3) The highest [25] 50 salaries paid to employees of
the institution that are not included under paragraph (2).
[(4) The report shall not include information relating
to individual donors.]
(5) Use of money appropriated by the General Assembly.

Section 3. This act shall take effect in 60 days.
