AN ACT
Amending Title 61 (Prisons and Parole) of the Pennsylvania
Consolidated Statutes, in general administration of
correctional institutions, providing for review and report
following escape or attempted escape.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 61 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
§ 1165. Review and report following escape or attempted escape.
(a) Security and staffing review.--In all cases in which an
inmate commits the offense of escape as described in 18 Pa.C.S.
§ 5121 (relating to escape), or attempted escape, while
incarcerated in a correctional institution, the department shall
conduct a full security and staffing review at the correctional
institution.
(b) Assistance.--The department shall conduct the review
under subsection (a) with the assistance of:
(1) The Commissioner of Pennsylvania State Police.

(2) A warden of a correctional institution from another
county selected by the department.
(3) Any other individual, agency or entity that the
department believes is necessary to assist in the review.
(c) Report.--
(1) Following the review under subsection (a), the
department shall issue a report that includes specific
recommendations to:
(i) Address flaws or shortcomings in security at the
correctional institution.
(ii) Address flaws or shortcomings in staffing at
the correctional institution.
(iii) Remedy any other issue that helped facilitate
the escape or attempted escape.
(2) The report under paragraph (1) shall be transmitted
to:
(i) The secretary.
(ii) The chairperson and minority chairperson of the
Judiciary Committee of the Senate.
(iii) The chairperson and minority chairperson of
the Judiciary Committee of the House of Representatives.
(iv) The president judge and county commissioners of
the county in which the correctional institution is
located.
Section 2. This act shall take effect in 60 days.
