department.
(c) Liability.--Liability may not be imposed on the
department, any other State agency or a local authority as a
result of designating or not designating a hayride crossing in
accordance with this section.
(d) Applicability.--A hayride combination shall not be
subject to the provisions of 66 Pa.C.S. (relating to public
utilities) when crossing a highway consistent with this section.
(e) Construction.--Nothing contained in this section shall
be construed to prohibit a person from operating a hayride
combination on a highway, if authorized by the department or a
local authority during a special event, special activity,
procession or assemblage, in accordance with section 6109
(relating to specific powers of department and local
authorities).
(f) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"Hayride combination." A combination consisting of a tow
vehicle and a single hayride trailer.
"Hayride trailer." A trailer, including a trailer that is
also an implement of husbandry, typically filled with straw or
hay and used to transport passengers:
(1) for amusement purposes on a farm or farms; or
(2) to and from locations on a farm or farms for
convenience, ease of access or for safety purposes.
"Passenger." The term does not include, with respect to a
person seated in a motor vehicle located on a farm, the owner of
the farm, a family member of the owner of the farm, an employee
of the farm or an individual residing on the farm.
