AN ACT
Amending the act of June 2, 1915 (P.L.736, No.338), entitled "An
act defining the liability of an employer to pay damages for
injuries received by an employe in the course of employment;
establishing an elective schedule of compensation; providing
procedure for the determination of liability and compensation
thereunder; and prescribing penalties," in procedure, further
providing for compromise and release.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 449 of the act of June 2, 1915 (P.L.736,
No.338), known as the Workers' Compensation Act, is amended by
adding a subsection to read:
Section 449. * * *
(e) The following apply:
(1) An employer may not require a claimant, as a condition
of settlement, through a signed additional agreement or
otherwise, to agree to any of the following:
(i) Refrain from reapplying for work.
(ii) Sign a confidentiality agreement.
(iii) Accept indemnification for a claim by Medicare.

(iv) Resign from employment with the employer.
(2) An agreement containing any of the prohibited conditions
of settlement specified under paragraph (1) shall be null and
void.
(3) An employer that violates paragraph (1) shall be subject
to the penalties provided under this act.
Section 2. This act shall take effect in 60 days.
