AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in minors, providing for curfew.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 18 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 6323. Curfew.
(a) Offense defined.--Notwithstanding any other provision of
law and except as provided in subsection (b), a minor is guilty
of a summary offense if the minor remains in a public place in a
municipality during the hours of a curfew established by law or
ordinance in the municipality.
(b) Affirmative defense.--It is an affirmative defense to a
prosecution for an offense under subsection (a) that the minor
was:
(1) accompanied by the minor's parent or guardian or by
another adult;
