AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in minors, providing for curfew.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 18 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 6323. Curfew.
(a) Offense defined.--Notwithstanding any other provision of
law and except as provided in subsection (b), a minor is guilty
of a summary offense if the minor remains in a public place in a
municipality during the hours of a curfew established by law or
ordinance in the municipality.
(b) Affirmative defense.--It is an affirmative defense to a
prosecution for an offense under subsection (a) that the minor
was:
(1) accompanied by the minor's parent or guardian or by
another adult;

(2) traveling by motor vehicle, train, bus or other mode
of transportation engaged in interstate travel;
(3) engaged in an employment activity or traveling home
from an employment activity, without any detour or stop;
(4) involved in an emergency; or
(5) in attendance at, or traveling home from, an
official school activity, religious activity or other
recreational activity sponsored by the Commonwealth, a civic
organization or other similar entity.
(c) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"Adult." An individual who is 18 years of age or older.
"Minor." An individual who is under 18 years of age.
"Municipality." A county, city, borough, incorporated town
or township.
Section 2. This act shall take effect in 60 days.
